MANSLAUGHTER SENTENCE OF RUSS FRANCOIS BALLARD REFERRED


The Criminal Cases Review Commission has referred to the Court of Appeal, the sentence imposed on Russ Francois Ballard following his conviction for manslaughter.
Mr Ballard was convicted of manslaughter at Maidstone Crown Court on 29th May 2002 and sentenced to 11 years imprisonment. He was found guilty of killing Mr Andrew Hodges by driving a car in a grossly negligent manner having consumed alcohol above the legal limit.

A Single Judge refused Mr Ballard leave to appeal against his sentence on 5th August 2002. He applied to the Commission on 6th August 2003.

After considering a number of issues the Commission has decided to refer the sentence to the Court of Appeal.
