15 February 2005 COMMISSION REFERS MR P RAPE CASE TO THE COURT OF APPEAL


The Criminal Cases Review Commission has referred the conviction for rape of Mr P to the Court of Appeal.
Mr P, who cannot be named for legal reasons, was convicted at the Central Criminal Court on 24 April 2002 and given an eight-year sentence.

He sought leave to appeal but was turned down by a Single Judge in December 2002. He first applied to the Commission in March 2003.

After reviewing the case the Commission declined to refer his conviction to the Court of Appeal. Mr P submitted a new application in October 2003 and after considering a range of issues including new evidence the Commission has decided to refer the case.

The Commission is the independent public body set up by Parliament in 1997 to investigate alleged miscarriages of justice in England, Wales and Northern Ireland and decide if they should be referred to the appeal courts.
