The Criminal Cases Review Commission has referred the sentence of Terrence Raymond Pollard for a new appeal.
Mr Pollard was convicted on 27 July 2003 at Preston Crown Court of burglary and burglary with intent to steal and sentenced to a total of eight years in prison. He was also ordered to serve 325 days of a previous sentence after being released on licence.
A Single Judge refused Mr Pollard leave to appeal against his sentence and he applied to the Commission in November 2004. Having considered the calculation of credit given for time served in custody while awaiting trial the Commission has decided to refer the case to the Court of Appeal.
The Commission is the independent public body set up by Parliament in 1997 to investigate possible miscarriages of justice in England, Wales and Northern Ireland to decide if they should be referred to the appeal courts.
