The Criminal Cases Review Commission has referred the convictions of four people for possession of false passports and attempting to obtain flights by deception to the Crown Court.
Mr Njdik Nazarian and Mr Raymond Sohrabian were convicted in April 1996 at Uxbridge Magistrates’ Court of the possession of a false instrument (a passport) with intent and attempting to obtain services (a flight to Canada) by deception.
They pleaded guilty to both offences in the magistrates’ court and were sentenced to two months’ imprisonment. They applied to the Commission on 9 October 2002
Mrs Magda Abwnawar and Mr Nasser Abwnawar were convicted in August 1998 at Uxbridge Magistrates’ Court of the possession of a false instrument (a passport) with intent and attempting to obtain services (a flight to Canada) by deception.
They pleaded guilty to both offences in the Magistrates’ Court and were sentenced to three months’ imprisonment; Mrs Abwnawar’s sentence was suspended for one year as she was pregnant and had a young son. Mr Abwnawar applied to the Commission on 21 July 2003 and Mrs Abwnawar on 16 October 2003.
The Commission considered Article 31 of the Refugee Convention in the context of developments in the common law and statute law.
The Commission is the independent public body set up by Parliament in 1997 to investigate possible miscarriages of justice in England, Wales and Northern Ireland to decide if they should be referred to the appeal courts.
