The Criminal Cases Review Commission has referred to the Court of Appeal the conviction of Patrick Michael Nolan for the offence murder.
On 27 May 1982 at Nottingham Crown Court Mr Nolan was sentenced to life imprisonment following his conviction for the murder of Mr Eric Carver on a day unknown between 18 and 23 December 1980.
The prosecution contended that Mr Nolan had entered Mr Carver’s home in the Lenton area of Nottingham in the early hours of the morning. In the course of searching the house he had gone upstairs into Mr Carver’s bedroom, where he had repeatedly struck Mr Carver about the head with a blunt instrument.
Mr Nolan unsuccessfully appealed against his conviction in March 1984. He applied to the Commission on 14 March 2000.
The Commission has considered issues including the reliability of Mr Nolan’s confession and developments in case law and has decided to refer the case.
The Commission is the independent public body set up by Parliament in 1997 to investigate possible miscarriages of justice in England, Wales and Northern Ireland to decide if they should be referred to the appeal courts.
