The Criminal Cases Review Commission has referred to the Court of Appeal the conviction of David Adeyemi Adetoro for conspiracy to rob.
On 23 June 1998 at Manchester Crown Court Mr Adetoro was sentenced to 26 years in prison, having been convicted on 17 June.
The prosecution contended that Mr Adetoro had been involved in a series of planned and actual robberies in the Manchester area, some armed.
Mr Adetoro appealed against his conviction and sentence. In June 1999 the Full Court dismissed his appeal against conviction but reduced his sentence to 22 years.
He applied to the Commission in October 2002. In June 2003 a decision was made not to refer the case. Mr Adetoro applied again citing new grounds in April 2004.
The Commission has considered a range of issues, including the judge’s directions to the jury in relation to Mr Adetoro’s silence in interview, and has decided to refer the case.
The Commission is the independent public body set up by Parliament in 1997 to investigate possible miscarriages of justice in England, Wales and Northern Ireland to decide if they should be referred to the appeal courts.
Mr Adetoro was not legally represented.
