17 August 2005 COMMISSION REFERS RAPE AND INDECENT ASSAULT CONVICTIONS OF JASON KELLY TO THE COURT OF APPEAL


The Criminal Cases Review Commission has referred to the Court of Appeal the convictions for rape and indecent assault of Jason Kelly.
Mr Kelly was convicted of rape and indecent assault on 15 October 2003 at Liverpool Crown Court. He received a total of five years in prison.

The prosecution contended that the offences related to a girl of 15.

A Single Judge refused Mr Kelly leave to appeal in January 2004. Mr Kelly applied to the Commission on 11 June 2004.

After considering issues including new information relating to disclosure, the Commission has decided to refer this conviction.

The Commission is the independent public body set up by Parliament in 1997 to investigate possible miscarriages of justice in England, Wales and Northern Ireland to decide if they should be referred to the appeal courts.

Mr Kelly is not legally represented.
