The Criminal Cases Review Commission has referred to the Court of Appeal the life sentence of Mark Jarvis for rape, two counts of robbery and kidnapping.
Mr Jarvis was convicted on 20 August 1998 and sentenced to life on 14 December 1998 at Wolverhampton Crown Court. The judge gave a recommendation that he serve a minimum of seven years and six months.
The prosecution contended that Mr Jarvis had kidnapped a woman, robbed her and forced her to withdraw money from cash machines before raping her.
A Single Judge dismissed an appeal against sentence by Mr Jarvis in March 1999 and the Full Court dismissed an appeal in July 1999.
Mr Jarvis applied to the Commission on 16 August 1999. He raised no new arguments and the case was not referred. He re-applied citing new grounds on 22 February 2005.
After considering issues including sentencing calculations and credit for time served on remand, the Commission has decided to refer this sentence.
The Commission is the independent public body set up by Parliament in 1997 to investigate possible miscarriages of justice in England, Wales and Northern Ireland to decide if they should be referred to the appeal courts.
