The Criminal Cases Review Commission has referred to the Court of Appeal the sentence for robbery of Mr Farooq Mohammed.
Mr Mohammed was convicted at Leeds Crown Court on 29 July 2003 of robbing £350,000 from a security van along with two other men. He was sentenced to 10 years in prison.
Mr Mohammed appealed against the sentence but was refused leave by a Single Judge in January 2004. In November 2004 his co-defendants appealed separately citing the fact that no firearm had been used. Their sentences were reduced.
Mr Mohammed’s legal representative contacted the Commission on 13th October 2005 after the Court of Appeal indicated the matter should be considered by the Commission. The Commission has now considered the case and decided to refer it for fresh appeal.
The Commission is the independent public body set up by Parliament in 1997 to investigate possible miscarriages of justice in England, Wales and Northern Ireland to decide if they should be referred to the appeal courts.
