The Criminal Cases Review Commission has referred the convictions of Ian Kenneth Whitehead for historic sex abuse to the Court of Appeal.
On 5 July 2001 at Peterborough Crown Court Mr Whitehead was convicted of six counts of indecent assault. He was sentenced to four years in prison.
The prosecution had contended that he had abused a boy in the late 1980s. The allegations were made against him in 2000.
Mr Whitehead sought leave to appeal out of time. His application was refused by a Single Judge in September 2003 and by the Full Court in March 2004. He applied to the Commission in April 2004.
The Commission has reviewed a range of issues in the case, including directions given at the trial, and has referred the case back to the Court of Appeal.
The Commission is the independent public body set up by Parliament in 1997 to investigate alleged miscarriages of justice in England, Wales and Northern Ireland and decide if they should be referred to the appeal courts.
